State of Arkansas Burning & Air Pollution Regulations Current as of July 31, 2006 Household Trash / Burn Barrels and Construction & Demolition Waste / Tires Arkansas State Air Pollution Control Regulations Section 18.6 (b) prohibits the open burning of waste materials. Specifically, it states that: No person shall cause or permit the open burning of refuse, garbage, trade waste, tires or other waste materials, or shall conduct a salvage operation by open burning (including lumber and/or wood). These are considered a waste material and cannot be burned according to State Laws.
However, these regulations do not apply to the following activities: · Fires used for the non-commercial cooking of food for recreational purposes, including barbecues and outdoor fireplaces in connection with any residence. Section 18.6(a)(1); · Open burning related to land clearing and agricultural activities. Section 18.6(c)(2); · Fires set or authorized by any public officer, board, council, or commission for the purpose of providing instruction in methods of fire fighting. Section 18.6(c)(7);(must conduct an asbestos survey per A.D.E.Q.) · Open fire used at construction sites only for the purpose of warming persons on the site during cold weather. Such fires shall be fueled only by untreated wood or wood products and must be confined within a container made of nonflammable material that does not exceed (30”) inches in width and length, unless prohibited by other local codes or ordinances.
